Katie Barajas focuses her practice on representing corporate and individual clients in criminal, civil, and administrative enforcement investigations and actions related to environmental laws, including those investigations associated with major accidents. Katie has experience representing oil and gas and chemical manufacturing clients in matters under the Clean Air Act Risk Management Program regulations. These matters frequently arise in the wake of a major accident, where a company is dealing with a multi-agency inquiry and trying to maintain their own business continuity. Katie's experience in this area includes criminal defense, negotiation of a national consent decree, responses to information requests, and negotiation of individual site penalty demands and administrative orders.
In addition, she also has experience representing construction and pipeline clients in matters under the Clean Water Act National Pollutant Discharge Elimination System (NPDES) program. In these matters, Katie has provided compliance advice, negotiated administrative penalty matters, and represented clients in state criminal and civil investigations. Katie has also represented both individual and corporate shipping clients in criminal investigations for violation of the Act to Prevent Pollution from Ships. She is part of a team providing advice to a monitor appointed by the court to oversee the probation of a shipping company convicted for such violations.
In other matters, Katie has assisted clients in responding to EPA's suspension and debarment office, including negotiation of administrative agreements to resolve suspension and debarment concerns, responding to show cause letters, and advising clients on disclosures to suspension and debarment offices.
