Baker Botts Secures Win for Samsung in Patent Case

NEW YORK, September 19, 2018 - Baker Botts L.L.P., a leading international law firm, announced today that it has won a finding of patent invalidity for its client Samsung Electronics America, Inc. in a patent litigation action brought by plaintiff William Grecia (Grecia v. Samsung Electronics America, Inc., filed in the Southern District of New York, Case No. 1:16-cv-09691).

Mr. Grecia has filed over 50 cases on the patent-in-suit against other companies.  In this case, Mr. Grecia had accused the Samsung Pay app of infringing a patent related to protecting digital content. After a claim construction hearing, Judge Richard J. Sullivan of the Southern District of New York ruled that all of the asserted claims of Mr. Grecia’s patent are indefinite, and, therefore, invalid.

“Over the years, we have had the opportunity to represent Samsung in a number of similar claims. We are happy to have again been able to secure a successful result for our client prior to trial,” said Neil Sirota, a New York based Intellectual Property Partner.

Baker Botts team members included: Neil Sirota (Partner, New York), who argued the claim construction hearing; Tim Durst  (Partner, Dallas); and Jonathan Cocks (Associate, New York).
